ARTICLE
l. MISSION STATEMENT
A. MISSION
STATEMENT
The mission
of the President Millard Fillmore Library is to make a positive
difference in the lives of our patrons by responsively providing
materials materials, information, and services at our library
and/or via the Library's World Wide Web site.
The Library
accomplishes this mission by:
* Providing books and other materials that will be
used to meet the informational, educational and recreational needs
of most library users.
* Promoting materials, programs, and services which
encourage reading and help patrons find information.
* Employing technology, both within the library and on
our Web site, which allows patrons access to needed information,
databases and services.
* Recruiting, selecting and training staff that
is able to meet the needs of the library patrons.
* Developing policies and procedures that
encourage patrons to use the library and to take responsibility
for their use of the library materials and services.
* Providing library services and facilities
which are attractive, easy to use, conveniently located and cost
effective to operate.
ARTICLE
Il. BOARDS
A. GOVERNING
BOARD
The City
Council constitutes the Governing Board of the President Millard
Fillmore Library.
(1)
The Mayor appoints, with the advice and consent of the City
Council, a library advisory board
.
(2)
The Mayor, with the advice and consent of the City Council,
appoints the library director and other library personnel.
Recommendations from the library advisory board may be
considered.
(3)
The City Council adopts the library budget and any necessary
amendments.
(4)
The City Council sets policy and procedure, which governs
library operations and personnel.
(5)
The City Recorder administers care and custody of all
library matters, including the building, under policy established
by the City Council.
B. ADVISORY
BOARD
The library
advisory board shall consist of not more than nine members as
defined in city ordinance, plus liaison and alternate members.
One member shall be a member of the Fillmore City Council.
East Millard towns which have paid user fees for their
residents may have a one-year liaison appointed as a member to the
library advisory board. All advisory board members, including the
member of the City Council are voting members; however, only
regular board members residing in Fillmore may serve as chairman.
Alternate Library Board Members will vote only when their
vote is needed to have a voting quorum.
Duties of the advisory board shall include but not be
limited to:
(1)
Attend all board meetings.
(2)
Plan and help carry out library fund raising activities,
library activities and programs, and public relations events.
(3)
Approve titles of library book proposed purchases;
recommend priority needs for board fund raising and grant monies
for city council budget consideration.
(4)
Recommend to the city council policies for public
relations, and library operations.
(5)
Receive recommendations from the library director
concerning library policies and operations.
ARTICLE
IIl. LIBRARY DIRECTOR
AND STAFF
A. APPOINTMENT
The library
director shall be the Library Department Head and shall be
appointed by the Mayor with the advice and consent of the City
Council, and be directly accountable to the City Recorder. The
library director shall be subject to the policies of Fillmore
City.
The library
staff shall be hired by the Mayor with the advice and consent of
the City council, and be directly accountable to the Library
Director under the supervision of the City Recorder.
The library staff shall be subject to the policies of
Fillmore City.
B. DUTIES
The library
director and library staff shall perform all duties outlined in
their respective job descriptions, as well as perform all other
duties as assigned. The
library director shall also supervise the library personnel and
operations. The
librarian shall be the executive officer of the advisory board,
but not a voting member. The
library director shall also manage the library budget as approved
by the City Council and observe all Fillmore City fiscal
procedures.
C. HOURS
Except as
approved by the City Recorder, the library director shall work 40
hours per week. Library
staff shall work the hours described in their job description.
Library hours shall be set by the City Council upon the
recommendation of the library director and advisory board.
Exceptions may be granted by the Mayor for special events
or programs.
D. CELLULAR
PHONE/PAGER USE
All library
personnel must use a silent ring setting or turn cellular
phones/pagers off while in the library.
Cellular phone/pager use will not be permitted in the main
library area.
ARTICLE
IV. FACILITIES
Policies for
use of the library facilities shall be regulated by the City
Council.
A. MULTI-PURPOSE
ROOM
(1)
Use of the library multi-purpose room shall be free to
the inhabitants of Fillmore City subject to the rules and
regulations established by the City Council. Use of the room
shall be rent-free for community, civic, or governmental
agencies. A deposit
may be require.
(2)
Other groups may rent the room for meeting purposes, but not for
the display or sale of products. The rental rate shall be
set by the Fillmore City Council.
(3)
Reservations shall be scheduled by the library director or the
library staff, preferably one week in advance. A checkout
system for the key to the multi-purpose room door will be used
if the room is scheduled for use outside regular library
hours. If the room is scheduled for use during regular
library hours, arrangements may be made with the library staff
to unlock the door.
(4)
When the multi-purpose room is used during hours the
library is closed, there will be no access to rest rooms or the
serving kitchen unless special arrangements have been made with
the library director.
(5)
A refundable cleaning and key deposit will be set by the
City Council, and shall be paid in advance by any group or person
using the room. Users
will be required to leave the room clean and in its original
order. Users shall
pay for any damages, and the deposit may be forfeited if the room
is not left in the same condition as at commencement of use.
B. MEETING
ROOMS
The
regulations for the multi-purpose room shall apply to all
library-meeting rooms.
C. RIGHT OF REFUSAL
Fillmore City
reserves the right to refuse use of any library facilities based
on past history and/or legal grounds.
ARTICLE
V. PATRON BEHAVIOR
A. PROGRAMS,
EVENTS, AND ACTIVITIES
Children in
the targeted age group of any library program, event, or activity
may be denied access to computer equipment during the event as
well as one hour before and one hour after.
An atmosphere
conducive to a public library must be maintained. The library is a
resource and learning center that must provide an environment for
concentration and learning. Unattended
children under the age of 12 will be allowed 45 minutes, except
when child is attending a scheduled library program, in the
library as long as they are not loitering.
(1)
Children under the age of 8 must be supervised by a parent
or adult.
(2)
Children (Youth) under the age of 18 must have a signed
parental (guardian) computer use consent form on file to be
eligible for computer use. Parent
(guardian) must sign computer use consent form in the library in
the presence of a librarian or notarized by a notary public.
(3)
Children under the age of 12 must be supervised by a parent
when using the computer.
(4)
Patrons must walk quietly. No running, pushing, shoving
hide-and-seek, or other activity not conducive to a public library
will be allowed.
(5)
Patrons must be engaged in book selection, reading,
studying, and using the puppet theater, computer, or other
teaching aids. No
loitering will be allowed.
(6)
Patrons must use a silent ring setting or turn cellular
phones/pagers off while in the library.
Cellular phone/pager use will not be permitted in the main
library area.
C. OTHER
POLICY
The library
is neither a nursery nor an entertainment center and does not
provide baby-sitting services, paper, pencils, crayons, etc.
D. VIOLATIONS
Patrons
violating library policy will be asked to leave and may have their
library privileges suspended or revoked.
ARTICLE
Vl. ADMINISTRATIVE
A. LIBRARY
CARDS
A library
card will be required for anyone wishing to check out library
materials. A family
card extends library privileges to all members of the family who
reside in the household. Patrons
must be 18 years of age to qualify for an individual library card.
A user fee will be charged to non-residents.
This fee will be waived for East Millard patrons whose
local governments have paid the annual user fee for their
citizens.
B. LIBRARY
REVENUES
Any revenues
collected in the library are to be remitted to the city treasurer
by 5:00 p.m. each business day.
C. FINES,
LOST ITEMS, AND INTER-LIBRARY LOANS
(1)
Fines set by the Fillmore City Council shall be assessed
for each day an item is overdue.
(2)
For each lost item, patrons shall either be assessed a fee based
on the replacement value plus administrative costs, or replace the
lost item with a new one.
(3)
Patrons requesting materials from the Utah State Library
Inter-Library Loan Program shall be charged per item for return
postage. Lost
materials are subject to the policy of the lending library.
Inter-Library Loan fee will be set by Fillmore City Council

COMPUTER AND INTERNET ACCESS POLICY
(1) Computer access with word
processing, publishing, and educational software shall be provided
for patron use. Copy
and computer print fees are as follows.
b)

(2)
Internet access shall be subject to the following
regulations.
a)As required by Section 9-7-215 and 9-7-216, Utah Code Annotated,
the library shall provide Internet safety for minors, including
the operation of a technology protection measure.
In furtherance thereof, the library shall:
i) Restrict
access to Internet or online sites that contain
material that is child pornography, harmful to minors or
obscene and use a web security filter designed to block access to
specific sites and subject matter.
ii)
For purposes of this policy:
1)
“Child pornography” is as defined in Section 76-5a 2,
Utah Code Annotated.
2)
“Harmful to minors” is as defined in Section
76-10-1201.
3) “Obscene” is as defined
in 20 U.S.C. Sec. 9101.
4)
“Technology protection measure” means a technology that
blocks or filters Internet access to visual depictions.
b)
The administrative procedures and guidelines for the
library staff to follow in enforcing the President Millard
Fillmore Library Policy will include the following:
i)
Provide access to the Internet as part of the mission to
provide academic resources.
ii)
Assist patrons in using the Internet to the extent that
time and other patron demand allows.
iii)
Maintain filtered Internet sites as dictated by the
President Millard Fillmore Library Board and Fillmore City Policy.
iv)
Re-evaluate access to a filtered site upon
submission of a completed "Request for Internet
Site Review" form.
All requests will be forwarded
to
the Fillmore City Council for a final decision.
v)
Report illegal activity conducted on the Internet or on the
library
premises. Illegal
acts involving library-computing
resources may be subject to prosecution by local, state, or
federal authorities.
c)
President Millard Fillmore Library:
i)
Will not tolerate disruptive or illegal behavior.
Patron will be given one warning before losing library
computer privileges for that day.
Second warning, library computer privileges will be
suspended for a period of one week.
Third warning, library computer privileges will be
suspended for a period of two weeks.
Fourth warning, library computer privileges will be
suspended for a period of three weeks.
Upon the fifth warning, all library computer privileges
will be permanently suspended, and the patron could possibly lose
all library privileges if he/she continues to be disruptive.
ii)
Will not be responsible for the availability or accuracy of
information accessible to patrons.
iii)
Will not accept responsibility for Internet use by children
and young people; this responsibility lies with the parents or
legal guardians.
iv)
Will not guarantee that the filtering software will be
totally
effective.
d)
Internet users agree to follow all library computer rules
and sign in
before using
computers. A
signature confirms agreement to abide
by the following rules.
Failure to comply may result in the loss of
library and/or library computer privileges.
i)
Not download any program(s).
ii)
Limit use to 1 hour per day.
iii)
Not access any type of chat line.
iv)
Not access any online sites containing material that is
“child pornography,” “harmful to minors” or “obscene”,
as those terms are defined in subsection D. (2) a) ii), of this
subsection.
v)
Pay printing fees.
vi)
Shut
down 30 minutes prior to closing time.
vii)
Pay a minimum technician fee or the actual amount to
restore computer operation if a computer operating program has
been corrupted by intentional misuse. Fee set by Fillmore City
Council.
e)
Patrons and staff may use the following procedures to
handle complaints about this policy, its enforcement, or about
observed patron behavior:
i)
Complaints concerning enforcement of the library Internet
policies may be submitted in writing to the President Millard
Fillmore Library Board. To
be considered valid, the complaints must state the date and
description of the issue, the names of the librarian(s) and
patron(s) involved, and signed and dated by the complainant.
ii)
The library board will review and investigate the
complaint, discuss possible resolutions and, if appropriate,
enforce those penalties consistent with D. (2) c) 1), of this
subsection. Provided,
a person who accesses online sites containing material that is
child pornography, harmful to minors, or obscene, as those terms
are defined in D. (2) a) ii), of this subsection, shall lose all
library computer privileges.
iii)
If the enforcement procedures under this policy are deemed
to be insufficient or if instituting additional enforcement
measures are deemed necessary by the library board, the library
board shall make recommendations to the City Council for adoption
and implementation.
f)
Any person may appeal the enforcement decision of the
library board under subsection (e) ii), above, to the Fillmore
City Council within 30 days of the library boards final decision.
g)
This policy shall be strictly enforced by the library
personnel.
h)
This policy shall become effective upon adoption by the
Fillmore City Council and shall be reviewed by the library board
at least every three years.

06/15/04).
E. PHOTOCOPIES
AND FAX MACHINE
President
Millard Fillmore Library will abide by copyright laws and will not
copy or Fax any material that may be a copyright infringement.
Copy and Fax fees are set by the Fillmore City Council.
F. ELECTRONIC
AND OTHER MISCELLANEOUS EQUIPMENT
President
Millard Fillmore Library will loan, to patrons 18 years of age or
older, specified electronic and other miscellaneous equipment.
Loans will be on a per day/weekend basis. A deposit will be required for all specified electronic and
other miscellaneous equipment.
The deposit will be refunded when the item is returned in
original condition. If
item is damaged, deposit will be retained and patron will be
charged for repair or replacement. Fillmore City Council sets the security deposit and rental
fees as published in the Fee and Rate Schedule.
Electronic Equipment consists of: cotton candy machine,
overhead projector, record players, slide projector, snow cone
machine, & typewriters. The
policy of Fillmore City shall be that the cotton candy machine and
snow cone machine are rented to non-profit civic groups only.
(i.e. Boy or Girl Scout Troops, school groups, etc.)
ARTICLE Vll. COLLECTION DEVELOPMENT
A. COMMUNITY
The President
Millard Fillmore Library is supported by, and recognizes as its
primary clientele, the citizens of East Millard County.
Fillmore City taxes, non-resident user fees, and grants
fund the library. In
order to most effectively meet the needs and interests of its
patrons, the library coordinates with local schools, community
organizations and the Utah State Library.
B. RESPONSIBILITY
FOR SELECTION
The
responsibility to determine the policy for the selection and
acquisition of library materials is vested in the Fillmore City
Council. The library
director and staff shall select materials with the general consent
of the library advisory board.
C. CRITERIA
FOR SELECTION
The chief
criterion is the intrinsic and over all value of each selection. Specific selection criteria include the following:
(1)
The author’s significance and/or reputation as a writer. Whether or not it
contributes to the balance and variety of the collection as
a whole.
(2)
Importance of the subject matter to the collection.
Whether or not it
contributes to the balance and variety of the collection as
a whole.
(3)
Timeliness or permanence of the work.
(4)
Community standards and interests.
(5)
Materials will be selected to facilitate self-education and
enrich and extend
interests that are evident in the community, and to
encourage reading,
listening, and reviewing as leisure activities.
(6)
Professional and highly specialized materials and
infrequently used
materials will not be purchased, but will be accessed via
the Internet or the
Inter-Library Loan program.
(7)
Aids in selection: recognized reviewing media, publishers
catalogs,
inspection and evaluation of new materials, suggestions
from library
patrons, and judgment of library staff and library advisory
board.
(8)
The value and impact of materials, which contain
controversial passages,
will be examined as a whole, because the significance of an
entire work
often transcend isolated words, phrases, or incidents.
D. FORMAT
OF MATERIAL
(1)
Periodicals: Purchases will be determined by usage and
budget
considerations.
(2)
Non-fiction: The library tries to maintain an
authoritative, up-to-date
collection for the general reader in the various fields of
knowledge.
General histories of the area, biographies, classic titles
and informational
and educational materials of interest and importance to the
community are
given priority consideration.
Within each subject area, priority is given to
those books/materials, which will serve the most readers.
(3)
Reference Materials: It is the intent of the library to
assist patrons with all
reasonable
reference requests. A reference section will be maintained
with up-to-date information, but will also include back
issues of certain
periodicals, local telephone directories, and local
newspapers.
Encyclopedias, dictionaries, atlas/map, and other
supplements will be
purchased. Information not available at the library will be sought via
the
Internet and Inter-library Loan.
The library reserves the right to assign
certain materials to “In House Use Only” status.
(4)
Adult Fiction: The library attempts to include notable
classic, popular
novels, and short stories.
(5)
Young Adult Materials: Selection of materials for young
adults will be
based on community interest, originality, and the treatment
of the subject
matter. Young
adult materials will be shelved with adult fiction.
(6)
Children’s Materials: Selection will be based on the
informational and
recreational
needs of young people from pre-school through age twelve.
Special consideration is given to originality, imagination,
graphic design,
and suitability of vocabulary, context, and format to the
age of the reader.
(7)
Large Print, Books-on-Tape and Other special Collection:
Special collections will be increased or decreased based on patron
usage.
(8)
Video Collection: The
library collection is made up largely from donations by the
general public. No
video with a rating higher than PG will be added to the
collection. If a
video with a rating of NR is donated or purchased, and there is a
question as to what the rating would actually be, the library
board will rate the overall content of the video.
Nudity of any kind will not be accepted.
(9)
Media room equipment: projectors, tape recorders, over-head
projectors,
etc. are available for patron use.
E. DONATIONS
AND GIFTS
(1)
Must meet the same selection criteria as purchased
materials. Upon
receipt all such materials become the property of the
library. Donation/gift
materials may be added to the collection, sold, exchanged,
given to other
organizations,
or discarded.
